1. Use at Your Own Risk

All Tanner Shoes products — including safety boots — are used entirely at your own risk. While our products are designed with care and durability in mind, we do not guarantee or warrant that our footwear will prevent injury, harm, or accidents in any circumstance.

To the maximum extent permitted by Australian law, Tanner Shoes, its affiliates, suppliers, employees, directors, and agents shall not be liable for any of the following:

Personal injury, physical trauma, or bodily harm (e.g. stepping on sharp objects, slips, falls, punctures, etc.);
Property damage of any kind;
Economic loss or loss of income or opportunity;
Consequential, indirect, special, or punitive damages;
Any other form of loss or harm arising from the use, misuse, or failure of our products, even if we were advised of the possibility of such damages.

This includes, but is not limited to, injuries that may occur despite wearing safety footwear, such as punctures from nails or sharp objects, electric shock, exposure to chemicals or heavy materials, or general accidents.

2. No Medical or Safety Guarantee

Unless specifically stated, Tanner Shoes products are not certified personal protective equipment (PPE) under AS/NZS standards or any other official regulation. While some models may include reinforced or heavy-duty features, this does not constitute a guarantee of protection or compliance with Australian workplace safety legislation.

Our footwear is not designed to treat or prevent any medical conditions.

3. Australian Consumer Law

Nothing in this disclaimer excludes, restricts or modifies any guarantee, condition, warranty, right or remedy which you may have under the Australian Consumer Law (ACL) or any other applicable legislation which cannot be lawfully excluded. However, to the extent permitted by law, Tanner Shoes limits its liability for any breach of a consumer guarantee (where legally allowed) to:

The replacement of the goods or the supply of equivalent goods;
The repair of the goods;
The payment of the cost of replacing the goods or of acquiring equivalent goods;
The payment of the cost of having the goods repaired.

4. Indemnity

You agree to indemnify and hold harmless Tanner Shoes, its owners, employees, and agents from any claims, demands, proceedings, liabilities, damages, losses, or expenses (including legal costs) arising out of:

Your use or misuse of our products;
Your breach of this disclaimer;
Any third-party claims relating to your use of our products.

5. Governing Law

This disclaimer and any disputes or claims relating to Tanner-shoes.com or our products shall be governed by the laws of the Commonwealth of Australia, and by the laws of the state or territory in which any dispute is brought. You submit to the exclusive jurisdiction of the courts of Australia.

6. Severability

If any provision of this disclaimer is held to be invalid or unenforceable under Australian law, that provision will be severed and the remaining terms shall remain in full force and effect.
